The role of the Senate in the Czech constitutional system

Abstract:

Cílem této bakalářské práce je se zabývat aktuálními debatami mezi odborníky na ústavní právo v oblasti změny pravomocí a kompetencí Senátu Parlamentu ČR. Text bude uvozen teoretickým vymezením, zejména pojmem bikamerismus s odkazem na jeho tradici i současnou pozici v českém ústavním systému. V další části bude vyložena geneze pravomocí a kompetencí horní komory. Práce dále zachytí aktuální situaci ohledně případných změn Ústavy týkajících se pravomocí a kompetencí Senátu. V hlavní části práce budou vybrány některé z diskutovaných změn (např. prodloužení lhůty na projednání zákonů, rozšíření výčtů zákonů vyžadujících souhlas Senátu apod.) a zpracovány jako případové studie. Vždy každá diskutovaná změna bude nejprve vysvětlena (s ohledem na debaty ústavních právníků a dalších expertů), následně pak budou uvedeny návrhy řešení. Předpokládá se realizace malého empirického šetření formou expertních rozhovorů, sledování debat ústavních právníků, debat v rámci Stálé komise Senátu pro Ústavu ČR a ústavní procedury apod.

Abstract:

The aim of this bachelor thesis is to address the current debates among constitutional law experts on the change of the powers and competences of the Senate of the Parliament of the Czech Republic. The text will be introduced by theoretical definitions, in particular the concept of bicameralism with reference to its tradition and current position in the Czech constitutional system. In the next part, the genesis of the powers and competences of the upper chamber will be explained. The thesis will also capture the current situation regarding possible amendments to the Constitution concerning the powers and competences of the Senate. In the main part of the thesis, some of the discussed changes (e.g. extension of the time limit for the consideration of laws, extension of the list of laws requiring the consent of the Senate, etc.) will be selected and elaborated as case studies. In each case, each of the discussed changes will first be explained (taking into account the debates of constitutional lawyers and other experts), followed by proposals for solutions. A small empirical investigation is envisaged in the form of expert interviews, observation of debates of constitutional lawyers, debates within the Senate Standing Committee on the Constitution of the Czech Republic and Constitutional Procedures, etc.
