Abstract:

Diplomová práce se zabývá pronásledováním čarodějnic v českých zemích, konkrétně na území Čech, Moravy a Slezska. Nezbytnou součástí je pohlédnutí na danou problematiku v evropském kontextu. Z hlediska časového vymezení se jádrem práce stává období 16. - 18. století. První kapitola líčí vznik a vývoj čarodějnictví. Kapitola následující přináší poznatky ze světa inkvizice a podrobně popisuje novou formu soudního řízení - inkviziční proces. Kapitola číslo tři nahlíží na otázku čarodějnictví v evropském měřítku. Závěrečná kapitola, tedy stěžejní část práce, se zaobírá problematikou čarodějnictví u nás. Velký důraz je kladen na procesy ve Velkých Losinách a v Šumperku. V práci není opomíjena otázka pronikání inkvizičního procesu do oblasti světského práva. Kromě literatury domácí je v práci využita i literatura zahraniční, především německá. Velká pozornost se věnuje otázkám, které jsou spjaty s právními knihami a zákoníky domácí provenience, jejichž ustanovení nevykazují až do vydání Hrdelního řádu císaře Josefa I. hlubší znalost diabolického čarodějnictví. Hlavním cílem diplomové práce je charakterizovat mechanismus vedení čarodějnických procesů (průběh vyšetřování, torturu, institucionální a právní vymezení) v Čechách, na Moravě a ve Slezsku a poukázat na odlišnosti procesů od jiných evropských zemí.

Abstract:

The thesis deals with witch hunts in Czech lands, particularly in the area of Bohemia, Moravia and Silesia. The issues from the view of the European context are its necessary part. From the point of view of the historical timeline the period between 16th and 18th century is the heart of the work. The first chapter explains the beginnings and development of the witchcraft. The next chapter brings knowledge of inquisition and description of a new form of court trials - the inquisition trial. The chapter three describes the issue of witchcraft within the bounds of Europe. The final chapter, the essential part of the thesis, deals with the witchcraft in Czech lands. Big emphasis is put on the trials in Velké Losiny and Šumperk. The matter of spreading inquisition trials in wordly law is not missed as well. Except for the Czech literature there is also used foreign literature, mainly the German one. The work is focused a lot on matters connected with law books and codes of Czech origin, whose enactments do not show, up to the issue of capital law of the emperor Josef I, deeper knowledge of diabolic witchcraft. The main aim of the thesis is to characterize mechanism of conducting witch trials (the course of investigation, torture, institutional and law definition) in Bohemia, Moravia and Silesia and show differences of trials in other European countries.
