Limitation of Fundamental Rights and Democratic Principles during Wartime

Abstract:

Práce se zabývá zejména ústavními možnostmi omezení demokratických principů a lidských práv a svobod. První část se zabývá ústavními možnostmi omezení standardních předpokládaných isntitutů demokratického právní státu, komentuje nález Ústavního soudu sp. zn.Pl.ÚS 27/09. V této části se hledá odpověď na otázku, co všechno může padnout za oběť zachování státu, aby tento stát ještě odpovídal svému charakteru definovanému v Ústavě. Druhá část se pak zaměřuje na otázku omezování (na podústavní úrovni) a snížování standartu lidských práv (na úrovni ústavní, novelou Listiny základních práv a svobod). Práce zdůrazňuje provázanost osudu lidských práv a svobod s podstatou demokracie, resp. demokratického právního státu. Zmiňuje existující možnosti omezení ve světle případného válečného konfliktu, ale vyjadřuje se také k potenciálním legálními legitimním timním možnostem případného dalšího omezování.

Abstract:

The thesis focuses especially on constitutional possibilities of limitation of democatic principles and human rights. The first part deals with constitutional options of restriction of standard aspects and of democratic state ruled by law, comments on the decision of the Constitutional Court no. Pl.ÚS 27/09. This part seek an aswer to the question of what can be sacrificed for the survival of the state in order to secure its´ existence, so that it still correspond with its´ character defined by the Constitution. The second part then elaborate on question of restriction (on the level of ordinary laws and by-laws) and lowering of the standard of human rights (on the level of Constitution and constitutional laws, by an ammendment of the Charter of Fundamental Rights and Freedoms). The thesis accentuates interconnection of human rights and with the basis of democracy, especially of the democratic state ruled by law. It mentions already existing possibilities of limitations and restrictions given a potential armed conflict, and it also elaborates on a potential legal and legitimate possibilities of further restrictions.
