The Principle of Good Faith and Fair Dealing in Insolvency Proceedings
Abstract:
Tato diplomová práce se zabývá projevem principu poctivosti v insolvenčním řízení. Autorka se v práci nejprve zaměřuje na obecný výklad pojmu poctivost, a to s ohledem na českou i evropskou právní úpravu. Dále je v práci popsán projev principu poctivosti v insolvenčním řízení z různých hledisek. V závěru práce autorka uvádí návrhy de lege ferenda.

This diploma thesis deals with the principle of good faith and fair dealing in the insolvency proceedings. First the author focuses on the general interpretation of the concept of good faith and fair dealing, and with regard to the Czech and European legislation.
