Ombudsman in Czech Republic and his Powers

Abstract:

Diplomová práce se zabývá působností Veřejného ochránce práv v České republice a jeho pravomocemi. Teoretická část práce se zabývá nejprve krátkým historickým exkurzem instituce veřejného ochránce práv a dále se poté věnuje platnému stavu zejména jeho legislativnímu zakotvení v řádu České republiky. Stěžejní část teoretické části se zaměřuje na vymezení pravomocí Veřejného ochránce práv a proces jejich uplatňování. Praktická část práce se zabývá působením Veřejného ochránce práv na úrovni vyšších územních samosprávných celků tedy krajů. Nejdříve obecně vymezuje oblasti, v nichž může dle platné právní úpravy Veřejný ochránce práv vůči krajům jako subjektům veřejné správy působit a následně se zabývá tím, kde konkrétně Veřejný ochránce práv vůči krajům působí a s jakými výsledky. Pro tyto potřeby byly krom jiného od krajů vyžádány podkladové informace, a to s využitím práva na informace podle zákona č. 106/1999 Sb., o svobodném přístupu k informacím, v platném znění. Na základě analýzy informací, které se podařilo získat, jsou na závěr formulována doporučení pro činnost krajů.

Abstract:

This diploma thesis deals with the the ombudsman’s competence and powers in the Czech Republic. The theoretical part of the thesis first offers a short historical excursion to the ombudsman’s institution and then deals with the current state, especially its legislative entrenchment in the Law of the Czech Republic. The main part of the theoretical part focuses on the definition of the powers of the Ombudsman and the process of their application. The practical part of the thesis deals with the work of the Ombudsman at the level of higher territorial self-governing units, ie regions. First, it generally defines the areas in which, according to the valid legal regulation, the Ombudsman can act in relation to the regions as entities of public administration and then deals with where in particular the ombudsman acts in relation to the regions and what the results of the activities are. For these needs, among other things, background information was requested from the regions, using the right to information pursuant to Act No. 106/1999 Coll., On Free Access to Information, as amended. Based on the analysis of the information that was obtained, recommendations for the activities of the regions are formulated in the conclusion.
