Criminal Law Protection of the Life and Health

Abstract:

Tato práce podává výklad trestněprávní ochrany života a zdraví v novém českém trestním zákoníku, který nabyl účinnosti 1. 1. 2010. Z důvodu obsáhlosti tohoto tématu se zaměřuje pouze na kategorii trestných činů proti životu a trestných činů proti zdraví, zpracovává tedy první dva díly prvé hlavy zvláštní části trestního zákoníku. Práce je uvedena stručným pojednáním o historických a ústavněprávních východiscích této problematiky. V závěru je krátce srovnána česká úprava s její obdobou ve slovenském trestním zákoně z roku 2005. Práce se rovněž snaží analyzovat některé nedostatky českého trestního zákoníku a nabídnout jejich řešení.

Abstract:

This work comments the criminal law protection of life and health in new Czech Penal Code, which came into effect on 1. January 2010. On the ground of comprehension of this subject this work targets only the caregory of crimes against life and crimes against health, it means compiles two first sections of the first top of the Penal Code. The work starts with a brief treatise on the historical and constitutional consequences of this subject. In conslusion there is compared the Czech enactment with its analogy in the Slovak Penal Code from the year 2005. The work endeavours also to analyse some inadequacies of the Czech Penal Code and to offer their solution.
