Abstract:

Práce si klade za cíl prozkoumat, zda se současná právní úprava exekučního řízení v exekučním řádu osvědčila, zda vyhovuje potřebám podnikatelské praxe, anebo zda by měla být naopak zrušena, jak požadují některé politické subjekty. Teoretická část práce se zaměřuje na rozdíly mezi čtyřmi způsoby vymáhání pohledávek podle českého právního řádu. V praktické části pak práce na základě několika konkrétních příkladů rozebírá, zda je současná úprava exekucí prováděných soudními exekutory pro podnikatele a podnikatelské prostředí u nás přínosem či nikoli. Na základě konkrétních poznatků ukazuje, že podnikatelské subjekty prakticky výlučně využívají způsobu vymáhání svých majetkových práv soudními exekutory a naopak se prakticky nikdy neuchylují k výkonu rozhodnutí prováděnému soudem.

Abstract:

The goal of this thesis is to evaluate, if the current executory regulation proved the expectations and properly supports the business needs and requirements or if it should be refused and terminated, as it is requested by some political subjects. Theoretical part of the thesis focus on evaluation of four ways of debts collection according to the Czech legal regulations and law. In the practical part is the thesis describing, based on several factual examples, if the current set up of executions provided by court executors, is beneficial for business environment or not. It shows, based on the factual findings, that business subject practically use only this option of execution of their property rights and practically never turn to the execution of the decision provided by the court. The conclusion coming from this thesis is showing, that to change the current way of law execution, using private executors nominated by court, would be the step back and disadvantage from the business perspective.
