Presidential Powers

Abstract:

Tato diplomová práce se zabývá vybranými pravomocemi prezidenta republiky. První část práce je věnována charakteristice postavení prezidenta v našem ústavním systému, odpovědnosti za výkon jeho funkce, problematice kontrasignace a možnostem soudního přezkumu jeho rozhodnutí. V Hlavní části se práce zabývá pravomocemi prezidenta v oblasti jmenování a odvolávání členů vlády a příjimání jejich demise, v jejímž rámci je pozornost zaměřena na možnost prezidenta odmítnout návrh na jmenování do určité funkce. Tyto pravomoci jsou v práci často demonstrovány na reálných případech české politické praxe.

Abstract:

This thesis deals with the selected presidential powers. The opening part revolves around the position of President in the Constitutional System of Czech Republic, presiedential accountability, the issues of contrasignation and possibility of judicial review of President’s decision. The main part of this thesis is devoted to presidential powers concerning the appointment and removal of the members of the government, and the acceptance of demission, with respect to the president’s discretion to reject the nomination. The above mentioned presidential powers are illustrated with with real political cases.
