Person or Thing in Juridical Sense?

Abstract:

Tato diplomová práce pojednává o osobě a věci v právním smyslu a o vybraných entitách, které buď nejsou řazeny do kategorie osob ani věcí, nebo o jejichž zařazení do některé z těchto kategorií jsou vedeny diskuze. Práce se nejprve zaměřuje na historický vývoj pojmů osoba a věc v právním smyslu, počínaje římským právem až po současnou právní úpravu v novém občanském zákoníku. Následně se již zabývá analýzou vybraných entit, které buď nespadají ani do jedné z těchto kategorií, a přesto je právo nějakým způsobem atrahuje do svého re-gulativního působení, anebo o jejichž zařazení do těchto kategorií jsou vedeny diskuze.

Abstract:

This diploma thesis deals with the concept of person and thing in jurid-ical sense and of selected entities that are either not classified as per-sons or things, or whose classification into one of these categories is subject to debate. The thesis first focuses on the historical develop-ment of these concepts, from Roman law to the current legal regula-tion in the new Civil Code. It then turns to an analysis of selected enti-ties which are either not regarded as persons nor things in juridical sense and yet are still drawn into the scope of legal regulation, or whose classification into these categories is subject to debate.
