Postavení a úloha polského Ústavního soudu v dělbě moci

Abstract:

Ústavní soudnictví plní v systému dělby moci demokratických právních států významnou úlohu. Z tohoto důvodu dění okolo ústavního soudnictví v Polsku v posledních několika letech vyvolalo řadu otázek, na které se tato práce pokouší odpovědět. Zejména hodnotí, jak se toto dění promítlo do současného postavení polského Ústavního soudu v systému dělby moci, přičemž vedle tohoto obsahuje také historický exkurz či hodnocení současné platné právní úpravy, např. otázky složení soudu a záruk nezávislého rozhodování tohoto orgánu. Úlohou polského Ústavního soudu je plnit roli ochránce ústavnosti, právního státu a základních práv a svobod. Zvláště významná je jeho role negativního zákonodárce, kdy je oprávněn rozhodovat o souladu normativních právních aktů s ústavou. V průběhu posledních dvou let se však hned několikrát změnila právní úprava, respektive zákon, který upravuje specifika řízení před tímto soudním orgánem, což se promítlo do jeho rozhodovací činnosti. Zásadní otázkou se také stal spor o obsazení polského Ústavního soudu, kdy v této věci apelovala na orgány Polské republiky Evropská komise a Rada Evropy. Práce tedy dále zaznamenává průběh těchto událostí, přičemž ty nejvýznamnější z nich posuzuje z pohledu práva, a zároveň se snaží nastínit přijatelná východiska, která by zajistila stabilitu systému dělby moci, respektive by zajistila stabilitu pozice Polského ústavního soudu a chránila by ji proti zásahům moci zákonodárné a výkonné.

Abstract:

Constitutional justice fulfills very important role in the state of law, or more precisely in separation of powers. That is the reason, why the situation around the the constitutional justice in Poland in recent years has revealed a number of questions that this thesis tries to answer. Especially evaluates how these events affected the current position of the Polish Constitutional Court in the system of separation of powers. Beside this also includes the short historical review of foundation of the Constitutional Court in Poland and evaluation of the current valid legislation, for example structure of this judicial authority and the guarantee of its independence. The task of the Polish Constitutional Court is to fulfill the role of the protector of constitutionality, the state of law and fundamental rights and freedoms. Especially significant is his role of the negative legislator, because the cour is competent to decide on conformity of normative legal acts with the Constitution. During the past two years parlament several times changed the legislation, which regulates some of the specifics of the proceedings before that judicial authority, consequence was the resulted in his decision-making. The crucial issue also became a dispute over the occupation of the Polish Constitutional Court. In this matter have also been involved the European Commission and the Council of Europe, which tried to appeal to the authorities of the Republic of Poland. Thesis reconstructs the course of events, and the most important of them judged from the perspective of law, while trying to to suggest an acceptable way that would ensure the stability of the system of separation of powers, or more precisely, ensure the stability of the position of the Polish Constitutional Court against the encroachments of the legislative and executive power.
