Legal actions of natural persons during a state of emergency

Abstract:

Diplomová práce se zabývá právním jednáním fyzických osob v době nouzového stavu. Cílem práce je vymezit dopady mimořádných opatření a nouzového stavu na vybrané aspekty právního jednání občanů České republiky. Na základě analýzy navrhnout možná zlepšení. Deskripce dopadů bude založená na analýze dostupných knižních a internetových zdrojů, které o dané problematice pojednávají. Práce je rozdělena na teoretickou a analytickou část. Teoretická část je zaměřena na charakteristiku právního jednání v obecném smyslu a právního jednání fyzických osob jako součást práva rodinného a pracovního. Analytická část práce obsahuje přehled konkrétních dopadů mimořádných opatření a nouzového stavu na vybrané aspekty právního jednání fyzických osob v oblasti omezení volného pohybu osob a omezení provozu sociálních a zdravotnických zařízení, omezení provozu maloobchodu a restaurací a omezení provozu vzdělávacích institucí. Stručně vymezuje dopad nouzového stavu na oblast trestního řízení. Zaměřuje se na komparaci aktuálního stavu ve vybraných oblastech právního jednání se stavem, který v těchto oblastech panoval v době nouzového stavu. Zjištěné poznatky zahrnují vlastní návrhy na zlepšení. V této práci je důraz kladen na analýzu negativních dopadů na právní jednání fyzických osob, které měly přímou souvislost s vyhlášením nouzového stavu a přijetím mimořádných opatření. Uvedená analýza může pomoci nejen odborníkům, ale též široké veřejnosti porozumět, do jaké míry bude jejich život ovlivněn v případě, že se uvedená situace bude opakovat.

Abstract:

The thesis deals with the legal conduct of natural persons during a state of emergency. The aim of the thesis is to define the impact of the emergency measures and the state of emergency on selected aspects of the legal conduct of citizens of the Czech Republic. Based on the analysis, possible improvements are suggested. The description of the impact will be based on the analysis of available book and internet sources that deal with the issue. The thesis is divided into theoretical and analytical parts. The theoretical part focuses on the characteristics of legal action in the general sense and legal conduct of natural persons as part of family and labour law. The analytical part of the thesis contains an overview of the specific impacts of the emergency measures and the state of emergency on selected aspects of the legal conduct of natural persons in the area of restrictions on the free movement of persons and restrictions on the operation of social and health care facilities, restrictions on the operation of retail. It briefly defines the impact of the state of emergency on the area of criminal proceedings. It focuses on comparing the current state of affairs in selected areas of legal conduct with the state of affairs that prevailed in these areas at the time of the state of emergency. The findings include its own suggestions for improvement. The emphasis in this thesis is on the analysis of the negative effects on the legal conduct of individuals that were directly related to the declaration of the state of emergency and the adoption of emergency measures. This analysis can help not only professionals but also the general public to understand to what extent their lives will be affected if the situation is repeated.
