Single Supervisory Mechanism and its implications

Abstract:

Tato diplomová práce systematicky představuje evropský regulatorní rámec Jednotného mechanismu dohledu (SSM), upravený prostřednictvím SSMR, a SSM zasazuje do širšího kontextu regulatorních změn dohledu po finanční krizi roku 2008, postavení SSM v rámci bankovní unie. Vedle SSM je bankovní unie tvořena pilířem druhým – Jednotným mechanismem pro řešení krize (SRM), a v budoucnu bude doplněna o prozatím nedokončený systém pojištění vkladů. Práce je členěna do tří kapitol. Kapitola první sleduje historické pozadí vzniku SSM, stručně probírá příčiny finanční krize, a následně zkoumá regulatorní odpověď na tuto krizi a vznik bankovní unie. Druhá kapitola od základů zkoumá zakotvení SSM do unijní právní úpravy a představuje jeho strukturu, zásady, povinnosti a pravomoci, vč. SREP. Třetí částí analyzuje práce autorů o dopadech zavedení SSM na vnitřní trh bankovnictví a hodnocení úspěšnosti SSM ze strany EU. Docházíme ke zjištění, že SSM můžeme hodnotit jako úspěšnou operaci, která vedla ke snížení rizik a zvýšení bezpečnosti, ale na druhou stranu s sebou přinesla vyšší nákladovost pro banky, a tudíž nižší ziskovost a efektivitu na bankovním trhu zemí SSM.

Abstract:

This thesis systematically presents the European regulatory framework of the Single Supervisory Mechanism (SSM), anchored through the SSM Regulation, SSM is placed in the broader context of regulatory changes in supervision following the financial crisis of 2008 and of the position of SSM within the banking union. In addition to the SSM, the banking union is formed by the second pillar – the Single Crisis Resolution Mechanism (SRM), and in the future will be supplemented by a deposit insurance scheme, which is not yet completed. The work is divided into three chapters. The first chapter traces the historical background of the emergence of the SSM, briefly discusses the causes of the financial crisis, and then examines the regulatory response to this crisis and the emergence of the banking union. The second chapter from the ground up examines the embedding of the SSM in EU legislation and presents its structure, principles, obligations and powers, incl. SREP. The third part analyzes the authors' work on the impact of the introduction of the SSM on the internal banking market and the assessment of the success of the SSM by the EU. We conclude that SSM can be evaluated as a successful operation that led to a reduction of risks and an increase in security, but on the other hand, it came with higher costs for banks, and therefore lower profitability and efficiency in the banking market of SSM countries.
