Housing cooperatives and problematic of transferring flats from cooperative ownership to personal ownership

Abstract:

Tato diplomová práce se věnuje bytovým družstvům a autorka se snaží najít řešení na vyvstávající ať už více či méně problematické otázky v jejich úpravě. V práci je zahrnuta, v poměru k celkovému obsahu, ne zcela krátká průprava o historii bytových družstev. Práce především v kapitole o výhodách a nevýhodách družstevního bydlení reflektuje rekodifikaci soukromého práva jako tomu ovšem ostatně i v jiných kapitolách. Navíc jsou některé kapitoly doplněny rozdíly od obecné úpravy družstev nebo různými zajímavostmi především ohledně navrhovaných legislativních změn. Poslední částí práce je problematika převodů družstevních bytů do vlastnictví člena, kde je (po nástinu historických událostí, které k přijetí tehdejší úpravy vedli) obsaženo zavedení povinných převodů a rozebrány otázky s tím související jako potřebná výzva nebo bezplatnost. Poněvadž povinný převod není jedinou možností převodu družstevního bytu do vlastnictví člena, jsou dále rozebírány včetně souvisejících otázek i převody dobrovolné. V návaznosti na to, protože pouze umožněním vlastnické právo převést proces převodu nekončí, je stručně popsán i tento proces a jeho kroky.

Abstract:

This diploma thesis deals with housing cooperatives. The author of the thesis tries to find solutions to current issues in the legislative regulation of housing cooperatives. The thesis includes a background analysis of the historical development of housing cooperatives. Compared to the total length of the thesis, this analysis is rather long, since the historical development of the individual cooperatives affects the (non-)existence of the legal title to transfer the cooperative flat to member ownership. The recodification of private law has been reflected in the thesis as some chapters include differences from the general legal arrangements relating to cooperatives. Apart from that, various interesting issues have been addressed, especially those associated with the proposed legislative changes. The final part of the thesis encompasses issues concerning transfers of cooperative flats to member ownership, including the implementation of compulsory transfers and the analysis of related issues, such as necessary notice or free transfer. The compulsory transfer is not the only way of transferring cooperative flats to member ownership. Thus, the thesis provides a detailed analysis of voluntary and other transfers. The thesis concludes with the description of the flat ownership transfer process.
