Usage of the Referendum as an Element of Direct Democracy: Comparison of France and Denmark in Postwar Period

Abstract:

Bakalářská práce se zabývá analýzou a komparací referend, která se konala ve Francii a Dánsku po roce 1945. Obě tyto země jsou charakteristické vysokou četností konání referenda a mimořádností, jež je institutu referenda připisována.Práce se dělí na tři části. První část je teoretická a představuje jednotlivé definice a klasifikace referend. Na konci této části jsou uvedeny další prvky přímé demokracie. Druhá část práce je zaměřena na představení ústavních podmínek. Jsou představeny části ústav Dánska a Francie, které se věnují referendům a podmínkám jejich vypisování. Na konci této kapitoly dochází ke komparaci těchto ústavních podmínek. Třetí část pojednává o jednotlivých referendech, která se konala ve sledovaném období. Tato část analyzuje jednotlivá referenda z hlediska obsahu, funkce a okolností, jež konání referenda doprovázely. Poté dochází ke komparaci referend dle stanovených kritérií.

Abstract:

The bachelor thesis deals with analysis and comparison of referendums held in France and Denmark after 1945. Both of these countries are characteristic by high frequency of referendums and by exceptionality they attribute to these institutes.The thesis is divided into four parts. The first part is theoretical and presents individual definitions and classifies referendums. Other essential elements of direct democracy can be found at the end of this part. In the second part are presented historical connections and political background of referendms in Denmark and France. The third part focuses on presentation of constitutional conditions. Parts of Danish and French constitutions dealing with referendums and requirements for their holding are introduced. Comparison of these requirements takes place at the end of this chapter. The fourth part denotes individual referendums held during monitored period. This part analyses each referendum in terms of content, function and incidental circumstances. Then referendums are compared according to stated criteria.
