Abstract:

Obsahem diplomové práce je široký popis opatrovnictví a poručenství. Tyto dva instituty se váží k osobám určitým způsobem omezeným danou překážkou. Tato způsobuje, že je třeba jim ustanovit opatrovníka nebo poručníka proto, aby byly chráněny jejich oprávněné zájmy. Práce počíná historií obou institutů, a to od ABGB, přes úpravy 20. století, až po současné znění zákonů. Opatrovnictví coby zákonné zastoupení je upraveno ve dvou předpisech soukromého práva, proto je práce rozdělena na část občanskoprávní a část rodinněprávní. První díl se zabývá problematikou opatrovnictví (z. č. 40/1964 Sb.), osoby opatrovníka a případů, kdy bude tento ustanoven, jeho práv a povinností. Druhé části je věnováno pojednání o poručenství a opatrovnictví dle zákona o rodině (z. č. 94/1963 Sb.), a to konkrétně pojmu poručenství, důvodům, osobě poručníka, obsahu funkce a zániku poručenství. Obě části jsou bohatě doplněny judikaturou. Diplomová práce obsahuje obsáhlé srovnání s novým občanským zákoníkem (z. č. 89/2012 Sb.), zejména pojednání o nových institutech v opatrovnictví, které doznalo značných změn. Závěr práce obsahuje srovnání současné úpravy se zákonným zněním na Slovensku a ve Francii.

Abstract:

The master's thesis contains a broad description of guardianship and tutelage. These two institutes are related to people in some way limited. This means that they need to appoint a guardian or tutor in order to protect their legimate interests. The master's thesis begins with the history of both institutes, from ABGB through modifications of 20th century to present text of the laws. Guardianship as a legal representation is governed by two rules of private law, so the thesis is divided into civil and family law section. The first part deals with guardianship (Act No. 40/1964 Coll.), who and when he may be established, his rights and obligations. The second part is devoted to the discussion of guardianship and tutelage under the Family Act (Act No. 94/1963 Coll.) specifically the concept of tutelage. Both parts are richly supplemented by case law. The thesis contains a comprehensive comparison with the new Civil Code (Law No. 89/2012 Coll.), it points on the new institutes in guadrianship which has undergone significant changes. The conclusion contains a comparison of the current law with the legal wording of law of the Slovak Republic and France.
