Initiation of Civil Preceedings

Abstract:

This bachelor work is contracted on civil proceedings before the Court, gives an overwievs of the ways how to begin civil proceedings as well as what are the elements of this proposal, who is the participant of this process, what conditions must be complied by a natural and legal person in order to be the participant of civil proceedings, the rights and obligations of these participants before the Court as well as representation of the Institute in civil proceedings and procedual act of the participants of this proceeding according to the provisions of the code of civil procedure. The first chapter is concentrated on a detailed explanation of the basic cancepts in beginning of civil proceeding. The second chapter is concentrated on who is the participant of this proceeding, what are the assumptions of a natural and legal person to be a participant of this proceeding, ňwhat are his or her rights a obligations before the Court. Finally, the last chapter points to the progress of civil proceedings

Abstract:

Bakalárska práca je zameraná na civilné konanie pred súdom, podáva prehľad o tom, akými spôsobmi môže začať občianske súdne konanie, aké náležitosti má návrh na začatie konania pred súdom, kto je účastníkom civilného procesu, aké predpoklady musí spĺňať fyzická a právnická osoba na to, aby mohla byť účastníkom civilného konania, práva a povinnosti týchto účastníkov pred súdom, ako aj inštitút zastúpenia v civilnom procese a procesné úkony účastníkov konania podľa príslušných ustanovení Občianského súdneho poriadku. Prvá kapitola je zameraná na podrobné vysvetlenie základných pojmov pre začatie občianského súdneho konania. Druhá kapitola je zameraná na to, kto je účastníkom civilného konania, aké musí mať predpoklady fyzická, alebo právnická osoba, aby mohla byť účastníkom civilného konania, a aké má práva a povinnosti pred súdom. Tretia kapitola poukazuje na samotný priebeh občianského súdneho konania.
