Abstract:

Diplomová práce na téma insolvenční řízení se v úvodní části zabývá účastníky insolvenčního řízení, mapuje průběh řízení ve všech jeho částech a představuje možnosti řešení úpadku dlužníka. Podstatná část je pak věnována aktuálním statistickým údajům o insolvenčním řízení v České republice. V návaznosti na získané vědomosti je na konkrétním insolvenčním řízení detailně popsán průběh úpadku dlužníka fyzické osoby podnikatele formou konkurzu a následném zpeněžení majetkové podstaty. Dovolím si navrhnout opatření, které by související odměny soudních exekutorů a insolvenčních správců vyrovnaly.

Abstract:

The diploma thesis on insolvency proceedings deals with the insolvency proceedings in the opening part, maps the course of proceedings in all its parts and presents the possibilities of solving the bankruptcy of the debtor. A substantial part is then devoted to the current statistical data on insolvency proceedings in the Czech Republic. In connection with the acquired knowledge, the particular insolvency procedure describes in detail the course of bankruptcy of the debtor of a natural person of the entrepreneur in the form of bankruptcy and subsequent monetization of the assets. I will allow myself to propose measures that would offset the related rewards of bailiffs and insolvency administrators.
