Law of property between spouses in the Roman Empire

Abstract:

Diplomová práce se orientuje na téma majetkového manželského práva v římské říši. Jejím cílem je analýza oblasti majetkového manželského práva v římské říši s akcentem na věno, darování mezi manželi a majetkové postavení manželky. Práce je vypracována metodou analýzy relevantních zdrojů, zejména dobových pramenů římského práva (jednotlivé spisy tvořící Corpus Iuris Civilis, primárně Digesta seu Pandectae) a odborné literatury. Kromě toho je využita metoda komparativní. Text je rozčleněn na pět kapitol, zabývající se postupně problematikou institutu manus a manželství v římském právu, věna, darování mezi manželi, darování před uzavřením manželství a vlastním majetkem manželky. Tam, kde je to účelné, je pro patřičný společensko-historický kontext věnována pozornost i tématu postavení ženy v dobové společnosti, typům římské rodiny a podobně. Přínosem práce je komplexní shrnutí tématu, kterému není v odborné literatuře českého původu věnována dostatečná pozornost.

Abstract:

This thesis focuses on the topic of property matrimonial law in the Roman Empire. Its aim is to analyze the area of matrimonial property law in the Roman Empire with an emphasis on dowry, gifts between spouses and the property status of the wife. The thesis is prepared by the method of analysis of relevant sources, especially contemporary sources of Roman law (individual writings making up the Corpus Iuris Civilis, primarily Digesta seu Pandectae) and professional literature. In addition, the comparative method is used. The text is divided into five chapters, dealing with the issues of the manus institute and marriage on Roman law, dowry, gifts between spouses, gifts before marriage and the wife's own property. Where it is expedient, for the appropriate social-historical context, attention is also paid to the topic of the position of women in contemporary society, types of the Roman family, and the like. The contribution of the work is a comprehensive summary of the topic, which is not given sufficient attention in the professional literature of Czech origin.
