Kryptoměny z daňového hlediska

Abstract:

Tato bakalářská práce si klade za cíl identifikaci možností transakcí s kryptoměnami a vyobrazení zdanění případných zisků z těchto transakcí. Toho je v práci docíleno metodou analýzy dat modelových případů. Zároveň jsou v práci jednotlivé případy porovnávány komparační metodou za účelem zjištění rozdílů mezi zvolenými formami podnikání a výběru vhodné alternativy formy podnikání pro poplatníka. Fyzická osoba může digitální měny směňovat za klasické fiat měny, darovat kryptoměny, nakupovat za ně zboží či služby a měnit jeden druh kryptoměn za jiný. Fyzická osoba podnikající a právnická osoba mohou digitální měny těžit a může za ně prodávat své zboží či služby. Fyzická osoba vždy vypočítává základ daně jako rozdíl mezi cenou kryptoměny při pořízení a jejím výdeji. Právnická osoba vypočítává základ daně z výsledku rozdílu mezi výnosy a náklady. Fyzická osoba podnikající musí na rozdíl od osoby právnické ze své činnosti odvádět zdravotní a sociální pojištění. Z toho důvodu je výhodnější uvažovat o podnikání ve formě právnické osoby. Omezením pro tvorbu této práce bylo neexistující legislativní vymezení kryptoměn a určení, jak s nimi nakládat.

Abstract:

This bachelor's thesis aims to identify the possibilities of transactions with cryptocurrencies and to desribe the taxation of any profits from these transactions. This is achieved by the method of data analysis of model cases. At the same time, individual cases are compared by using a comparative method in order to find out the differences between the chosen forms of business and to choose a suitable alternative form of business for the taxpayer. An individual person can exchange digital currencies for classic fiat currencies, donate cryptocurrencies, buy goods or services with them, and exchange one type of cryptocurrency for another. An Individual person doing business and a legal entity can mine cryptocurrencies and can sell their goods or services for them. An individual person always calculates the tax base as the difference between the price of the cryptocurrency upon acquisition and its expanse. The legal entity calculates the tax base from the result of the difference between revenues and costs. Unlike a legal entity, an individual person running a business must pay health and social insurance from their activity. For that reason, it is more advantageous to consider doing business in the form of a legal entity. The limitation for the creation of this work was the non-existent legislative definition of cryptocurrencies and the determination of how to deal with them.
