Comparing economic sanctions imposed by the European Union on Russia after the annexation of Crimea and the invasion of Ukraine

Abstract:

Ekonomické sankce jsou pro Evropskou unii relativně častým nástrojem zahraniční politiky. Od roku 1989 se na sankčním seznamu Evropské unie vyskytly cíle pocházející z desítek zemí po celém světě. I když frekvence užívání sankcí v Evropské unii stoupá, jejich vnímání ve veřejných a odborných kruzích mnohdy nasvědčuje tomu, že se jedná o nespolehlivý prostředek. Toto vnímání vychází zejména z přesvědčení, že sankce mají sloužit výhradně k donucení cílového aktéra změnit své chování. Takové pojetí sankcí je ovšem v současnosti přinejmenším zastaralé a nereflektuje jejich rychle se vyvíjející moderní charakter. Z tohoto důvodu vzniká potřeba revidovat klasické teoretické přístupy. V posledních letech bylo běžným cílem sankcí pocházejících z Evropské unie Rusko. V roce 2022 sankce tvořily podstatnou část většího celku všech opatření, která byla zavedena v reakci na vojenskou invazi Ukrajiny Ruskem. V roce 2014 je Evropská unie aktivně využila s cílem omezit ruské destabilizační aktivity na Ukrajině po anexi Krymu, zejména stálé poskytování podpory separatistickým skupinám. Tato práce se zabývá porovnáním těchto dvou instancí sankcí na základě evaluací jejich úspěšnosti a efektivity. Základním principem evaluace je zakomponování sankcí do celkového kontextu zahraniční politiky Evropské unie. Právě zohlednění širšího kontextu zahraniční politiky umožňuje i jiná pojetí sankcí, než je to, které je charakterizuje jako výhradně donucovací prostředek. Vyhodnocení se váže na 4 hlavní kritéria: širší kontext zahraniční politiky, typ a logika sankcí, dopady, účinky a efektivita sankcí a komparativní užitek sankcí. Z komparace vyhodnocení vyplývá, že sankce z roku 2014 a sankce uvalené po invazi Ukrajiny v roce 2022 jsou odlišné zejména z hlediska celkového kontextu zahraniční politiky Evropské unie vůči Rusku a Ukrajině, a dále z hlediska jejich dopadů a efektivity. Naopak rozdíly z hlediska komparativního užitku sankcí a jejich logiky jsou v obou případech nepatrné.

Abstract:

Economic sanctions are a very frequent instrument of foreign policy of the European Union. Since 1989 sanctions have been imposed on targets in dozens of countries across the world. Even though the frequency of use of sanctions by the EU has been increasing, the perception of sanctions in the eyes of the public and the academia sometimes suggests that they are not a reliable means. This perception for the most part stems from the understanding that sanctions serve exclusively as a coercive tool, in other words, that they are designed only to force their target to change its behavior. This understanding, however, is outdated and does not reflect their rapidly evolving modern character. The classic theoretical approaches are therefore in need of revision. In recent years EU sanctions have commonly targeted Russia. In 2022 sanctions were an important part of all measures taken in response to the military invasion of Ukraine by Russia. In 2014 sanctions were actively used by the EU to constrict Russian destabilizing activity on Ukrainian territory, primarily its support of separatist groups. This paper focuses on comparing the two instances of sanctions based on individual evaluations of their effectiveness. The basic principle of the evaluation is incorporating the sanctions within the greater context of the foreign policy of the EU. Incorporating the sanctions into the whole of foreign policy allows for different understandings than that which posits sanctions as an exclusively coercive instrument. The evaluation is based on 4 main criteria: the wider context of foreign policy, the logic of sanctions, the impacts and the effectiveness of sanctions and their comparative utility. The comparison shows that the most prominent differences between the sanctions imposed in 2014 and the ones imposed after the Russian invasion of Ukraine in 2022 are in terms of the wider context of the foreign policy of the EU towards Ukraine and Russia and also in terms of their impact and effectiveness. On the other hand, in terms of their logic and comparative utility, the difference is quite marginal.
