Abstract:

Diplomová práce se zabývá analýzou procesu vymáhání směnečných pohledávek v prvostupňovém nalézacím řízení. Cílem práce bylo představit budoucím účastníkům směnečného řízení proces, ve kterém mohou uplatnit svá práva plynoucí ze směnek, s ohledem na změny od roku 2012 do současnosti. Úvod práce je stručným exkurzem do hmotného práva směnečného. Následuje pojednání o charakteru směnečného řízení a jeho postavení v civilním procesu. Autorka se též věnuje uplatňováním nároků ze směnek v rozhodčím řízení. Klíčová část práce se zabývá zkráceným směnečným řízením, které se dělí na dvě fáze. V první fázi řízení, tzv. rozkazním řízení, se žalobce domáhá vydání směnečného platebního rozkazu. V případě, že soud vydá směnečný platební rozkaz a žalovaný proti němu vznese námitky, následuje fáze druhá, tj. řízení o projednání námitek. Důraz je kladen na změny týkající se zákazu použití zajišťovacích směnek u spotřebitelských úvěrů, doručení směnečného platebního rozkazu a prodloužení lhůty pro podání námitek. V závěru práce autorka kriticky hodnotí směnečné řízení podle platné právní úpravy a předkládá náměty de lege ferenda.

Abstract:

The present thesis analyses the process of enforcement of the bills receivable in the first-instance adjudicatory proceedings. The aim of the thesis was to present to the future participants of the bill-of-exchange proceedings the process in which they can exercise their rights arising from bills of exchange, given the changes from 2012 to the present. Introduction is a brief excursion into the substantive exchange law. The following part is a disquisition on the nature of exchange proceedings and its position within the civil trial. The author also deals with the application of the claims of bills of exchange in the arbitration proceedings. The key part of the thesis deals with the summary bill-of-exchange proceedings, which is divided into two phases. In the first phase of the proceedings the order proceedings the plaintiff seeks the issuance of a bill payment order. If the court issues the bill payment order and the defendant raises objections against it, there is a second phase the objections proceedings. The emphasis is put on changes relating to the prohibition of the use of custodial bills of exchange for consumer credits, bill payment order delivery and the extension of the time for objections filing. In the final part of the thesis, the author presents a critical evaluation of the bill-of-exchange proceedings according to current legislation and proposes possible future legal regulations.
