Inheritance proceedings and the protection of the legitimate successors

Abstract:

The topic of this bachelor work is an „ Inheritance proceedings and the protection of the legitimate successors“. An inheritance is important part of the private law in the Slovak republic. It means the transfer of rights and obligations of legator to his successor, as well as the acquirement of property forming the subject of succession to the legal successors. After the testator´s death follow the inheritance proceedings, which consist of many procedural steps. Inheritance proceedings are closely related to protection of the legitimate successors, which are intented to avoid situations where inheritance after the end of the proceedings will be reported to person other than the legitimate successors. The first chapter is dedicated to an introduction of the topic. It briefly describes the basic conditions of succession, inheritance groups, as well as the inheritance of the law and inheritance of the will. The second chapter describes in detail subject of the work itself, which are the inheritance proceedings. In subchapters there are discussed various stages of the inheritance proceedings, from the begining and course of actions to the actual decision in the proceedings. The fourth chapter is dedicated to the certificate of inheritance as a form of termination of the inheritance proceedings. Last chapter focuses on the protection of the legitimate successors, responsibilities of the improper successors towards the legitimate and the possibility of enforcing the rights of legitimate successors to the court. The aim of bachelor work is mainly to describe the inheritance proceedings, its course and termination and the related protection of the legitimate successors.

Abstract:

Témou bakalárskej práce je „Konanie o dedičstve a ochrana oprávnených dedičov“. Dedenie predstavuje významnú súčasť súkromného práva Slovenskej republiky. Znamená prechod poručiteľových práv a povinností na jeho právnych nástupcov, ako aj nadobudnutie majetku tvoriaceho predmet dedenia zákonnými dedičmi. Po poručiteľovej smrti nasleduje konanie o dedičstve, ktoré sa skladá z celého radu procesných úkonov. S konaním o dedičstve úzko súvisí ochrana oprávnených dedičov, ktorej zámerom je predísť situáciám, kedy dedičstvo po skončení dedičského konania pripadne osobám iným, ako sú oprávnení dedičia. Prvá kapitola je venovaná úvodu do problematiky. Opisuje v skratke základné predpoklady dedenia, dedičské skupiny, ako aj dedenie zo zákona a zo závetu. Druhá kapitola podrobne opisuje samotnú tému práce, ktorou je konanie o dedičstve. V podkapitolách sú rozobraté jednotlivé fázy konania o dedičstve od začatia konania, priebehu konania až po samotné rozhodnutie v konaní. Štvrtá kapitola je venovaná osvedčeniu o dedičstve, ako jednej z foriem skončenia konania o dedičstve. Posledná kapitola je zameraná na ochranu oprávnených dedičov, na povinnosti nepravých dedičov voči oprávneným a na možnosti domáhania sa práv oprávnených dedičov na súde. Cieľom bakalárskej práce je predovšetkým popísať konanie o dedičstve, jeho priebeh a skončenie a s tým súvisiacu ochranu oprávnených dedičov.
