Abstract:

Práce je věnována ohledání mrtvoly a místa jejího nálezu. Pojednává se zde o této problematice z teoretického a praktického hlediska. V teoretické části je rozebrána problematika definice ohledání místa činu, místa nálezu a místa zjištění. Nadále je zde nastíněná právní úprava a podrobně rozebrány obecné zásady a zajišťování stop na místě činu, a to jak z pohledu orgánu činné v trestním řízení, tak i z velké části soudního lékaře. A to z důvodu, že tyto orgány musí velmi úzce spolupracovat. Práce je obohacena praktickými zkušenostmi pracovníků Policie ČR a jsou v ní na závěr rozebrány dva skutečné případy, kdy se potvrdilo, že nelze vytvořit univerzální postup při ohledání mrtvoly, neboť tato problematika je velmi individuální.

Abstract:

This thesis concerns corpse examination as well as scene inspection. The topic is discussed both from theoretical and practical point of view. The theoretical part concerns definition of crime scene examination, scene of discovery and scene of detection. Further, the law as well as general guidelines, concerning evidence collection at the crime scene are discussed; both from the prosecuting authorities and forensic medicine viewpoints. These institutions need to cooperate closely. he thesis is enriched with practical experience of Czech Police force. Two real cases are analysed, and it is shown, that there is no universal approach to corpse examination since the problematic is rather individual.
