Supply of digital content and digital services to the consumers

Abstract:

Práce se zabývá problematikou poskytování digitálního obsahu a digi-tálních služeb spotřebitelům. Hlavními cíli této práce jsou vymezení nové právní teorie a terminologie digitálních dat, analýza nové právní úpravy poskytování digitálního obsahu a digitálních služeb, zejména v závazkové rovině, a prozkoumání vybraných otázek smluvní praxe da-ného tématu. Práce zkoumá nedostatky právní úpravy de lege lata ve vztahu k právní teorii i smluvní praxi a ke zjištěným nedostatkům na-vrhuje možná řešení de lege ferenda.

Abstract:

This thesis analyses the topic of supply of digital content and digital services to the consumer. The purposes of this thesis are to create compilation of legal theory and terminology in the context of supply of digital data, to analyse the new law that regulates the supply of digital content and digital services, with focus on obligations, and to explore selected issues the market practice regarding the topic. The thesis also examines the de lege lata problems of the legal regulation with respect to legal theory and contractual practice, and proposes possible de lege ferenda solutions.
