Abstract:

V této diplomové práci se autor zevrubně zabývá problematikou nezákonné nečinnosti správních orgánů, přičemž pozornost soustředí zejména na možnosti ochrany, kterou adresátům veřejné správy čelícím pasivitě správních orgánů v současnosti nabízí jednak stávající správní řád, tedy zákon č. 500/2004 Sb., jednak zákon č. 150/2002 Sb., soudní řád správní. V práci autor čtenářům poskytuje ucelený obraz o tématu a odpovídá na nejrůznější otázky, jež mohou v souvislosti s ochranou proti nečinnosti správního orgánu vyvstat. Protože na nesčetné množství otázek souvisejících s možnostmi ochrany proti nečinnosti správních orgánů již v minulosti odpověděly správní soudy, představuje judikatura správních soudů, především pak Nejvyššího správního soudu, hlavní zdroj, z něhož autor této práce čerpal. Skutečnost, že se k mnohým souvisejícím otázkám musel v minulosti několikrát vyjadřovat rovněž rozšířený senát Nejvyššího správního soudu, je dokladem především toho, že výklad zákonné úpravy sám o sobě v praxi mnohdy činí problémy. Ochrana proti nečinnosti správního orgánu představuje proto problematiku, jež si hlubší teoretická zpracování nepochybně zasluhuje. Autor s ohledem na specifika doby, v níž se tématem této kvalifikační práce při jejím zpracovávání hlouběji zabýval, věnoval jednu z kapitol rovněž otázce, jak se do činnosti a fungování správních orgánů projevila stávající epidemiologická krize.

Abstract:

In this master thesis, the author deals with the issue of unlawful inactivity of administrative authorities in detail, focusing in particular on the possibilities of protection offered to addressees of public administration who might be facing the passivity of administrative authorities. The protection is currently offered by the Code of Administrative Procedure, that is Act No. 500/2004 Coll, as well as Act No. 150/2002 Coll, the Code of Administrative Justice. In the thesis, the author provides readers with a comprehensive picture of the topic and replies to various questions that may arise in connection with the protection against inactivity of the administrative authority. As countless questions related to the possibilities of protection against inactivity of administrative authorities have been already answered by administrative courts in the past, the case law of administrative courts, especially the Supreme Administrative Court, represents the main source which the author of this thesis drew from. The fact that the enlarged Senate of the Supreme Administrative Court also had to express its opinion on many related issues on several occasions in the past is evidence that the interpretation of the legislation itself often causes problems in practice. Protection against inactivity of an administrative authority therefore presents issue that undoubtedly deserves deeper theoretical elaboration. With regard to the specifics of the time in which the author dealt with the topic of this master thesis, one of the chapters is concentrated on the question of how the current epidemiological crisis has affected the activity and functioning of administrative authorities.
