Diversions in criminal procedure and ist consequences for criminality prevention

Abstract:

Cílem práce je zmapovat specifické způsoby trestního řízení, zejména pak podmíněného zastavení trestního stíhání, seznámit s obsahem těchto institutů pomocí bližšího rozboru těchto pojmů za využití jak trestněprávní literatury, tak odborné literatury z oblasti prevence a restorativní justice, postihnout funkce těchto právních instrumentů a v neposlední řadě předložit reálný obraz výsledků jejich působení ve společnosti, jejich efektivnost a to prostřednictvím analýzy faktických dat z dané oblasti shromážděných empirickým průzkumem, mimo jiné ve spolupráci s oblastní pobočkou Probační a mediační služby v Chomutově a konfrontovat získané výsledky se záměry, jenž zdůvodňovaly zavedení těchto institutů do českého právního řádu. Součástí práce je také statistická analýza počtu prováděných úkonů Probační a mediační službou ČR v rámci přípravného řízení a řízení před soudem za období let 2003 – 2008 dle §307 tr. řádu. K vyhodnocení jsou použity některé elementární charakteristiky časových řad a dále jednoduchá metoda analýzy časových řad, vyjádřená trendovou funkcí. Data jsou zpracována pomocí programu MS Excel.

Abstract:

The aim of this work is to map out specific ways of criminal proceedings, particularly the conditional suspension of prosecution, in order to acquaint those institutions with a more detailed analysis of these concepts. Criminal literature and literature in the field of prevention and restorative justice will be used, and the affect of how these legal instruments function will be assessed. Lastly, this seeks to provide a realistic picture of the results of their role in society, their effectiveness through analysis of factual data from the sample area and an empirical exploration, amongst other things, in cooperation with the regional branch of the Probation and Mediation Service in Chomutov, of the results gathered with the objectives that justify the introduction of these institution in Czech law. A part of this work is a statistical analysis of the operations of the Probation and Mediation Service in the Czech Republic in the initial proceedings and trial for the period 2003 - 2008 by § 307 tr. Procedure. The evaluation method uses some elementary features of the time series and the simple method of analysis of time series in terms of trend functions. All data is processed using Microsoft Excel.
