Self-incrimination and Cryptography

Abstract:

Tato diplomová práce se zabývá problematikou zásady zákazu sebeobviňování v kontextu kryptografie. Účelem je zjistit, jak zásada zákazu sebeobviňování dokáže reagovat na technologické výzvy v podobě šifrování a jaké jsou problémy tohoto možného konfliktu. Práce je rozdělena na obecnou a zvláštní část, přičemž každá z nich se věnuje jinému pohledu na problematiku. Obecná část se zabývá fungováním zásady zákazu sebeobviňování v českém právním řádu a jak její ochranu vnímá český Ústavní soud. Zvláštní část se naopak věnuje americkému fungování tzv. privilege against self-incrimination a řešení Nejvyššího soudu Spojených států amerických. Práce v závěrečných kapitolách komparuje české a americké výstupy a uplatňuje zjištěná řešení na možné prolomení jednotlivých metod autentizace.

Abstract:

This thesis addresses the issue of the privilege against self-incrimination in the context of cryptography. The purpose is to see how the privilege against self-incrimination can respond to the technological challenges of encryption and what are the problems of this potential conflict. The thesis is divided into a general and a special section, each of which takes a different perspective on the issue. The general part deals with the functioning of the principle of the prohibition of self-incrimination in the Czech legal system and how its protection is perceived by the Czech Constitutional Court. The special part, on the other hand, is devoted to the American functioning of the so-called privilege against self-incrimination and the solution of the Supreme Court of the United States. In the final chapters, the thesis compares the Czech and American outcomes and applies the identified solutions to the possible breaking of the different authentication methods.
