Current developments in reforms of public administration at field of town and country planning and the Building Act

Abstract:

Veřejná správa v České republice prošla podobně jako všechny ostatní činnosti po společenských změnách v roce 1989 celou řadou proměn. Mezi nejvýznamnější reformní procesy lze zahrnout dvě etapy v působení veřejné správy, ve kterých došlo k výrazným změnám v její organizaci, které jsou označovány jako reforma veřejné správy. V České republice byl přijat tzv. smíšený (spojený) model státní správy a samosprávy s cílem přiblížit státní správu občanům. Diplomová práce se zabývá dopady reformy veřejné správy na výkon státní správy na úseku stavebního řádu a územního plánování. V úvodu jsou obecně vyhodnoceny realizované etapy reformy veřejné správy, další část práce se věnuje problematice působnosti stavebních úřadů a úřadů územního plánování a to jak po stránce historické, tak z hlediska jejich současného působení. Činnost těchto úřadů, jejich struktura a způsob výkonu státní správy je podroben důkladné analýze s využitím metody systémové, komparatistické a zčásti historické. Stěžejní část práce – vyhodnocení navrhovaných reforem stavebních úřadů a úřadů územního plánování (koncepcí Ministerstva vnitra ČR a Ministerstva pro místní rozvoj ČR) pomocí metody systémové, statistické, komparatistické a normativně dogmatické a návrh vlastního řešení organizace na úseku stavebního řádu a územního plánování je předmětem poslední části práce. Rozsáhlá analýza reformy veřejné správy a návrhu na její dokončení, podrobný rozbor výkonu stavebních úřadů a úřadů územního plánování a dalších souvisejících činností veřejné správy a následně analýza navrhovaných reforem na úseku stavebního řádu a územního plánování prokázala celou řadu nedostatků v organizaci i činnostech výkonu státní správy na svěřeném úseku. Zjištěné problémy jsou shrnuty do sedmi okruhů a spočívají zejména v negativních dopadech spojení výkonu státní správy se samosprávou, ve zrušení okresních úřadů a vytvoření nového typu obcí s rozšířenou působností, roztříštěnosti stavebních úřadů, nedostatečné provázanosti s dalšími složkami státní správy a v neskladebnosti územně správních jednotek. Výsledkem diplomové práce je návrh vlastního řešení reformy veřejné správy na úseku stavebního řádu a územního plánování a dalších souvisejících činností, který spočívá v definování pěti konkrétních opatření, která požadují důkladnou revizi stavebního zákona, změnu struktury stavebních úřadů a úřadů územního plánování ve spojení s dalšími příbuznými agendami a nové efektivnější rozdělení jednotlivých pracovních činností. Navrhovaná opatření by měla vést ke zlepšení výkonu stavebního úřadu a úřadu územního plánování a k vyšší efektivitě státní služby v uvedených úsecích státní správy.

Abstract:

Public administration in the Czech Republic - as well as other activities - has undergone a lot of transformations since the social changes in 1989. To the most important reform processes belong two periods in the effectiveness of the public administration - during the periods the organization of the public administration has been significantly changed - they are called the reform. The Czech Republic has applied the so called mixed model of public administration and local administration, its purpose was to get the public administration closer to citizens. This degree work deals with the impact of the public administration reform on the state administration efficiency in the department of building regulations and planning authority. The introduction generally evaluates the realised periods of the public administration reform, the next part is devoted to the problems of building offices and town and country planning authorities competence - both from the historical and current effectiveness points of view. The work of the authorities, their structure way of public administration execution have been thoroughly analysed - using systematic, comparative and partly historical methods. The last and essential part od this degree work deals with the evaluation of suggested building offices and and town and country planning offices reforms (Ministry of the Interior and Ministry of the Regional Development conception). Systematic, statistical, comparative and normatively dogmatic methods were used to suggest the author´s own solution of the organization of the building regulations and town and country planning department. A thorough analysis of the reform of the public administration and a recommendation of its completion , a detailed analysis of the effiency of the building offices and town and country planning offices and other activities connected with the public authority have been done. A following anylisis of the suggested reforms within the building regulations and town and country planning departments proved a lot of lacks in the organization and activities of the public authority in the touched section. The proven problems have been summarized into seven spheres. They are mainly based on the negative impact of the fusion of the public administration and local authorities, the cancellation of district offices and the creation of a new type of municipalities with extended powers, the fragmentation of building offices, the lack of interconnection with other parts of the public administration and the bad structure of the administration units. This degree work result is the author´s suggestion of the solution of the public administration reform within the building regulations and town and country planning departments and other connected activities. The solution is based on five specific steps requiring a thorough revision of the building act, a structure change of the building offices and town and country planning authorities in connection with other related office work and a new - more effective - devision of respective work activities. The suggested steps should lead to a better efficiency of the building offices and town and country planning authority and a higher effectiveness of the state service in the above mentioned public authority departments.
