The question of the continuity of Roman law from 6th to 12th century on Apennine Peninsula

Abstract:

Disertační práce zpracovává téma dějin římského práva v období 6. až 12. století na Apeninském poloostrově. Jejím základním cílem je seznámit čtenáře s právněhistorickým sporem týkajícím se otázky kontinuity římského práva a blíže se zaměřit na tři oblasti (právní vzdělání, počty dochovaných rukopisů Digest a existující citace Digest), které odkrývají možnou odpověď, následně pak představit koncept renesance římského práva a jejího historického kontextu, vykreslit okruh historických postav spojených s obnovou významu římského práva ve středověké společnosti a zodpovědět otázku: Proč se římské právo stalo v 11. a 12. století znovuobjeveným zdrojem inspirace?

Abstract:

There has been a lengthy dispute among legal historians over the question of whether the Roman law was in continuous use in the period between the 6th and 12th centuries. The main aim of this thesis is to introduce the reader to the background and arguments of this dispute and to take a closer look at three areas (legal education, the number of extant Digest manuscripts and the existing Digest quotations) that reveal a possible answer. The Renaissance of Roman law is then introduced in its historical context, and a circle of historical figures associated with the revival of Roman law in medieval society is outlined. The aim of this section is to answer the question "Why was Roman law rediscovered as a source of inspiration in the 11th and 12th centuries?"
