Judicial Moderation of Contractual Sanctions

Abstract:

Tato diplomová práce se komplexně zabývá problematikou soudní moderace smluvních sankcí. Úvodní část práce se věnuje analýze právní úpravy soudní moderace a zaměřuje se též na možnosti moderace jednotlivých institutů. Druhá kapitola pojednává o předpokladech soudní moderace smluvních sankcí. Následující kapitola se zabývá vybranými procesními aspekty soudní moderace. Poslední kapitola přehledně vymezuje systém soudní moderace smluvních sankcí. Závěrem jsou shrnuty nejdůležitější poznatky této diplomové práce.

Abstract:

This diploma thesis concerns the issue of judicial moderation of contractual sanctions. The introductory chapters are dedicated to analysis of the legislation of judicial moderation and also are focused on possibilities of moderation of particular institutes. The second chapter discusses prerequisites for judicial moderation of contractual sanctions. The following chapter deals with selected procedural issues of judicial moderation. The last chapter provides an overview of judicial moderation of contractual sanctions system. In conclusion, the most relevant findings of this diploma thesis are summarized.
