Abstract:

Cizinecké právo je specifickou oblasti správního práva s dynamicky se rozvíjející právní úpravou. Problematika pobytu cizinců je v současné době velmi aktuální vzhledem k počtu cizinců, kteří na území ČR přicházejí, zde pobývají a usazují se, či přes naše území cestují do jiných cílových zemí ať už z ekonomických, sociálních a jiných důvodů nebo v souvislosti s uprchlickou krizí. Můj zájem o téma pobytu cizinců je dán i tím, že jsem v ČR sama prošla integračním procesem jako cizinka a mám k této problematice blízko i v souvislosti se svým povoláním soudního tlumočníka jazyka čínského. Tato práce se zabývá tématem pobytových oprávnění cizinců ze třetích zemí dlouhodobějšího charakteru a pojednává o otázkách jejich povolování, prodloužení a ukončení. Mým cílem bylo nejen popsat stávající situaci povolování dlouhodobých pobytových oprávnění, jejich druhy a strukturu, ale také v širších souvislostech prozkoumat související instituty cizineckého práva a analyzovat stěžejní pojmy, na kterých rozhodování v řízeních o pobytová oprávnění zakládá. Pokusila jsem se podat čtenáři ucelený obraz zákonné úpravy v oblasti dlouhodobých pobytových oprávnění cizinců ze třetích zemí a aktuálního stavu relevantní soudní judikatury. Tato práce obsahuje celkem sedm kapitol, ze kterých první a poslední kapitola jsou úvod a závěr s úvahami de lege ferenda. Stěžejní kapitoly číslo dvě až šest se bezprostředně věnují avizované problematice. Tak druhá kapitola pojednává o vývoji právní úpravy po roce 1989 a o historii změn zákona č.326/1999 Sb. s akcentem na problematiku pobytových oprávnění dlouhodobějšího charakteru. Třetí kapitola je věnována otázkám pobytových oprávnění typu dlouhodobé vízum a dlouhodobý pobyt, jež v hierarchii integračního procesu cizince jsou počátečními a nejnižšími články. Trvalému pobytu jako nejvyššímu pobytovému statusu cizince, otázkám jeho povolování, zrušení a ukončení se zabývá kapitola čtvrtá. Pátá kapitola pojednává o povolení k přechodnému pobytu rodinného příslušníka občana Evropské unie včetně občana ČR ve smyslu hlavy IV cizineckého zákona. Nakonec kapitola šestá se věnuje procesním aspektům souvisejícím s udělením, zrušením nebo ukončením dlouhodobých pobytových oprávnění cizinců.

Abstract:

Alien Law is a specific part of the Administrative Law with dynamically developing legal regulations. The issues concerning the residence of foreigners is currently very relevant due to the number of foreigners that enter the territory of the Czech Republic, residing and settling here or traveling through our country to enter other countries both for economic, social and other reasons or in relation to the migration crisis. My interest in the residence of foreigners is also given by the fact that I passed the integration process in the Czech Republic as a foreigner and I am very close to the subject due to my profession of a court appointed interpreter in Chinese. This thesis deals with the topic of long-term residence permits for foreigners from third countries in respect to issuing of permits, their prolongation and termination. My aim was to describe the current situation in respect to issuing of long-term permit, their types and structure, but also to research the relevant issue of the Alien Law in broader terms and to analyze the topical items, on which the decision-making on permits is based. I attempted to provide the reader with a consistent picture of the legal regulations relating to long-term residence permits for foreigners from third countries and the current status of the relevant court practice. This thesis contains seven chapters, where the first and the last chapters are an introduction and a conclusion with de lege ferenda consideration. The main chapters are chapters two to six, which concern the previously mentioned issues. The second chapter deals with the development of legal regulations after 1989 and with the history of amendments to Law no. 326/1999 Coll. accenting the issues regarding long-term residence permit. The third chapter deals with the issues of permits such as long-term visas and long-term residence permit, which are the initial and the lowest levels in the integration process of foreigners. The permanent residence, as the highest residence status of a foreigner, the issues relating to granting, cancellation and termination is included in chapter four. The fifth chapter deals with the temporary residence permit for a family member of an EU citizen, including a citizen of the Czech Republic, in the meaning of Chapter IV of the Alien Law. Finally, chapter six deals with the procedural aspect relating to granting, cancellation or termination of long-term residence permits for foreigners.
