Public contract replacing zoning and building permit for the construction of "college VŠTE"

Abstract:

Cílem práce je sestavit veřejnoprávní smlouvu nahrazující územní rozhodnutí a stavební povolení na koleje VŠTE. V této práci chci poukázat na tuto možnost realizování daného záměru. V podvědomí lidí existuje jen klasické stavební povolení a tato možnost veřejnoprávní smlouvy je často nevyužita. Veřejnoprávní smlouva od podání, z pravidla do 14 dnů, je vyřízena, naproti klasickému stavebnímu povolení může trvat až tři měsíce. Sestavení veřejnoprávní smlouvy na projekt, které mi poskytlo Projektové a inovační centrum VŠTE. Na základě projektové dokumentace sestavím veřejnoprávní smlouvu, která je cílem mé bakalářské práce. Prvním bodem této smlouvy bude úvodní ustanovení. Druhá část jsou smluvní strany, kde je uveden jako první strana příslušný stavební úřad a druhou stranou stavebník. Mezi těmito dvěma stranami se smlouva uzavírá. Bodem číslo tři jsou třetí osoby, které sousedí se stavebním záměrem. Bod číslo čtyři je předmět smlouvy, v této části je umístění stavby, druh a účel stavby, přesné umístění stavby na pozemku, prostorové řešení stavby, provedení stavby. Bodem pět jsou stanovené právní předpisy a ustanovení této smlouvy. Bod šest obsahuje souhlasy dotčených orgánu s číslem projednání a stanovisky. Bod sedům upřesňuje podmínky umístění stavby, provedení stavby. Pod bodem osm je řešena doba trvání smlouvy. Bod devět je společná ustanovení, pod tímto pojmem se rozumí, že každá smluvní strana dostane jeden stejnopis smlouvy a potvrdí jej podpisem a svými iniciály.

Abstract:

The aim is to build a public treaty to the zoning and building permit on track VŠTE. In this work, I want to point out the possibility of implementing the plan. In the subconscious of people there's only classical building permits and the possibility of a public contract is often unused. Public contract by filing the rule in 14 days is processed, opposite the classical building permit can take up to three months. Build a public contract for the project, which gave me the design and innovation center VŠTE. On the basis of project documentation to put together a public contract that is the goal of my thesis. The first item of this contract will be introductory provisions. The second part of the contracting parties, which is listed as the first party to the relevant planning authority and the other side builder between those two parties to the contract is concluded. Point number three is the third person, which is adjacent to the construction project. Point number four is the subject of the contract, in this part of the building's location, type and purpose of the building, the exact location of the building on the plot, the spatial design of the building, building construction. The point of the five established laws and provisions of this Agreement. Point six contains the consent of the authority to hear and number of reviews. Seven point specifies the conditions building placement, building construction. Under point eight is solved duration of the contract. Point nine is a common provision, this term means that each party receives one copy of the contract and confirm it with their signature and initials.
