Abstract:

Bakalářská práce je zaměřena na vytvoření uceleného pohledu na problematiku soudnictví v České republice. Moc soudní je zde charakterizována jako třetí pilíř státní moci a soudnictví jako činnost nezávislých soudů podle příslušných pravidel. Je zde také popsána civilní pravomoc soudů, příslušnost soudů a jejich druhy. V práci je dále popisována organizace soudů, dělení na obecné soudy a zvlášť stojící Ústavní soud, včetně jeho rozhodování a řízení před tímto soudem a jejich vzájemné vztahy v rámci soudní soustavy. Soudci a soudní osoby jsou zde popsáni z pohledu jejich pozice u soudů, a také z pohledu jejich ustavování do funkce.

Abstract:

The Bachelor thesis is focused on creating a comprehensive overview of the issues of the judiciary in the Czech Republic. The judicial power is characterized here as the third pillar of the State power and the judiciary as the activity of the independent courts, according to the relevant rules. It also describes the civil jurisdiction, the cognizance of the courts and their types. The thesis also describes the organizational structure of the courts, the division into general courts and the constitutional court of the Czech republic, including its decision-making and the hearing before this court and their mutual relations within the system of courts. Judges and judicial persons are described from the point of view of their position in the courts, as well as from the point of view of their appointment to the office.
