Legal Consequences of Marriage Imperfections
Abstract:
Práce definuje hlavní pojmy jako je manželství, vznik manželství a manželské překážky. Popisuje proces vzniku manželství a předkládá souhrn podmínek pro vznik manželství. Práce se následně zaměřuje na neplatné manželství a zdánlivé manželství, na vypořádání právních vztahů, právní úpravě v SRN a návrhu nového občanského zákoníku v ČR.
Abstract:
The work defines main notions as marriage, formation of the marriage and matrimonial impediments. The process of the marriage formation is described and a summary of marriage solemnization conditions is given. The work is further focused on the void marriage and the putative marriage, the settlement of legal relationships, the legal regulation in Germany and on the new draft of the Civil Code in the …more
