Employee’s Incapacity to Work and Legal Character of Medical Certificates

Abstract:

Tématem této diplomové práce je „Zdravotní nezpůsobilost zaměstnance k výkonu práce a právní povaha lékařských posudků“. Jejím cílem je rozbor příčin zdravotní nezpůsobilosti zaměstnance deklarované lékařským posudkem poskytovatele pracovnělékařských služeb nebo rozhodnutím správního orgánu, jenž lékařský posudek přezkoumává a důsledků, které má tato zdravotní nezpůsobilost na pracovněprávní poměr. Hlavní pozornost je přitom věnována lékařskému posudku, jakožto povinnému podkladu pro úkon zaměstnavatele či zaměstnance podle zákoníku práce. Úvodní kapitola obsahuje vymezení pojmu „BOZP“ a popis práv a povinností účastníků pracovního poměru souvisejících s ochranou zdraví při práci. Druhá kapitola definuje zdravotní nezpůsobilost zaměstnance k výkonu práce a zabývá se také podrobně její příčinami a důsledky. Kapitola třetí stručně popisuje proces zjišťování zdravotního stavu zaměstnanců. Poslední a nejrozsáhlejší kapitola se zabývá lékařskými posudky se zaměřením na jejich právní náležitosti a právní povahu.

Abstract:

The topic of this thesis is „Employee’s Incapacity to Work and Legal Character of Medical Certificates“. Its goal is to analyse causes of employee’s incapacity to work declared by medical certificate of a doctor active in labour medical services or by decision of administrative authority that reviews the medical certificate and consequences, which brings this incapacity to employment relationship. Major attention is paid to the medical certificate, as a mandatory basis for the employer’s or the employee’s action. The introductory chapter contains definition of the term "BOZP" and description of the rights and obligations of the employment relationship’s participants related to the health protection at work. Second chapter defines employee’s incapacity to work and deals also in detail with its causes and consequences. The third chapter briefly describes the process of examination of the employees’ health. The last and most comprehensive chapter deals with the medical certificates focusing on their legal particulars and legal nature.
