Abstract:

Tato práce se zabývá významem a pojetím svobodné vůle a jejím vztahem k morální odpovědnosti ve světle vybraných filozofických pozic. Široký teoretický základ práce nabízí prostor ke zorientování se v množství specifických pojmů a jejich definic, které se k problematice váží. Dílčím cílem textu je zmapování spektra přístupů, které nabízí zejména filozofická obec jako propracovaný základ chápání významu a podmínek existence svobodné vůle. Záměrem práce je následně posouzení, jakou roli hraje v trestní odpovědnosti svobodná vůle. V jednotlivých kapitolách jsou zmíněny významné postřehy z oblasti neurovědy, které se výsledky svých experimentů snaží obohatit současné filozofické teorie o další rozměr. Práce je rozdělena do tří tematických celků. V prvním jsou nastíněna obecná východiska pro náhledy na kauzalitu a příčinnost, která mají zásadní význam pro to, co je později nazýváno jako „dilema determinismu“. V druhém celku se věnuji tomu, co pro jedince znamená být „odpovědný“ v právním a morálním smyslu a jakým způsobem se s morální odpovědností vypořádávají vybrané filozofické pozice. Práci uzavírá pojednání o teorii trestání jako odezvy systému na provinění jedince proti stanovenému řádu.

Abstract:

The thesis deals with the meaning and the concept of free will and its relation to moral responsibility in terms of selected philosophical approaches. Broad theoretical background offers smoother understanding of specific terminologies and their definitions. Partial aim of the thesis is interpretation of selected theories, submitted by philosophers in particular, which are used as a base of understanding the meaning and conditions of free will. Overall aim of the thesis is evaluation of free will in terms of criminal responsibility. Important observation from neuroscience point of view are mentioned as well. There were presented some significant results of variety of experiments, which can be understood as a different view on free will. The thesis consists of three thematic areas. In first area, there are presented basic explanations of causation and its importance for what is later called as „dilemma of determinism“. In next chapters I deal with the meaning of being responsible in legal and moral terms and what is the position of moral responsibility in the view of selected philosophical theories, which were introduced earlier in this paper. Finally, in last chapters are presented the most significant theories, which try to justify punishment as authorized feedback to breaking rules.
