Women at the Law-Court during the Early Modern Period, Applied to the Example of the Town of Chrudim (in the 16th century)

Abstract:

Tato práce se zabývá postavením ženy v raně novověkém právu, vymezenou na určitou lokalitu - město Chrudim, královské věnné město s vlastním hrdelním soudem. Na něj jsou aplikovány poznatky z městského práva, které využívají tištěných pramenů: Práva městská od Brikcího z Licka a Práva městská království českého a markrabství moravského s krátkou jich summou Pavla Kristiána z Koldína. Jako příklady jsou použity dále materiály čerpané ze Státního okresního archivu Chrudim. Cílem je představit ženu nejen jako {\clq}qčinitelku zla``, ale také jako oběť a ukázat, že mnohdy spravedlnost byla k jejímu pohlaví skoupá

Abstract:

The thesis is concerned with the role of a woman in the Early Modern law; the theme is restricted by a location - the town of Chrudim, a royal dowry town which had its own court that was allowed to deliver death penalties. The findings from the town privileges, which used the following printed sources: Práva městská od Brikcího z Licka (Town Privileges by Brikcí of Licko) and Práva městská království českého a markrabství moravského (Town Privileges of the Kingdom of Bohemia and the Margraviate of Moravia) and their brief summary by Pavel Kristián of Koldín; are applied to the example of the town of Chrudim. The materials taken from the sources of Státní okresní archiv Chrudim (State District Archive in Chrudim) are also used as examples. The aim of the thesis is to introduce a woman not only as a ``harm factor'q but also as a victim; and to demonstrate that the justice was often illiberal to her gender
