Criminal offences in traffic

Abstract:

Stěžejním záměrem předkládané bakalářské práce, která se věnuje otázce trestných činů v dopravě, je především detailně popsat relevantní právní úpravu, dále také uvést definici základních pojmů v oblasti dopravy a také v oblasti dopravních nehod. Cílem bakalářské práce je vymezit a charakterizovat jednotlivé trestné činy, které úzce souvisí s dopravou, zejména silniční, a výklad jednotlivých trestných činů doplnit o rozhodovací praxi soudů. V další části práce je pak poukazováno především na příčiny protiprávního jednání v oblasti dopravy. Pozornost je věnována rovněž pojednání o osobnosti pachatele dopravních nehod. Do bakalářské práce je systémově zařazena také komparace trestných činů spáchaných při řízením motorového vozidla pod vlivem alkoholu a rovněž právní rámec řízením motorového vozidla v případě, kdy v důsledku nehody došlo ke smrtelnému následku v České republice a také ve Velké Británii.

Abstract:

The main purpose of the submitted bachelor's thesis, which deals with the issue of criminal offenses in transport, is to describe in detail the relevant legislation, as well as to define the basic terms in the field of transport and also in the field of traffic accidents. The aim of the bachelor's thesis is to define and characterize individual crimes that are closely related to transport, especially road, and to supplement the interpretation of individual crimes with the decision-making practice of courts. In the next part of the work, the causes of illegal actions in the field of transport are pointed out. Attention is also paid to a treatise on the personality of the perpetrator of traffic accidents. The bachelor's thesis also systematically includes a comparison of crimes committed while driving a motor vehicle under the influence of alcohol, as well as the legal framework of driving a motor vehicle in the event of a fatal consequence in the Czech Republic and the United Kingdom.
