Ideological sources of the advancement of human and civil rights formulated in the declarations of the rights of man and the citizen in the states of North American Union and during the French Revolution and their reflection in the current legal system of the Czech Republic

Abstract:

Obsahem práce je popis deklarací práv člověka a občana ve státech severoamerické unie (Virginská prohlášení práv z r. 1776, Deklarace – konstituce státu Massa-chusetts, Ústava Spojených států amerických z r. 1787, Listiny práv Spojených států amerických z r. 1791), francouzské Deklarace práv člověka a občana z r. 1789 a ně-kterých jejich ideových zdrojů (Jean Jacques Rousseau a Charles Montesuieu) se zaměřením na lidská práva a svobody. Dále se práce zabývá tím, jakým způsobem se výše uvedené historické dokumenty odráží v právním řádu České republiky. Práce byla napsána z důvodu stálé aktuálnosti a využitelnosti myšlenek obsažených v uvedených historických dokumentech. Cílem práce je popis a rozbor, jak jsou lidská práva a svobody a vztahy občan – stát, obsažené v uvedených historických dokumentech, reflektovány v současném právu České republiky. Při zpracování tématu byla použita metoda popisná, historická a srovnávací.

Abstract:

The thesis describes and analyses the declarations of human and civil rights in the states of the North American Union (the Virginia Declaration of Rights from 1776, the Declaration and Constitution of Massachusetts, the Constitution of the United States of America from 1787, the Bill of Rights of the United States of America from 1791), the French Declaration of the Rights of Man and the Citizen from 1789 and some of their ideological sources (Jean Jacques Rousseau and Charles Mon-tesuieu) with a focus on human rights and freedoms. Furthermore, the thesis deals with the way in which the above-listed historical documents are reflected in the legal system of the Czech Republic. The thesis was written because ideas contained in these historical documents remain topical and usable also in our era. The aim of the thesis is to describe and analyse how human rights and freedoms, as well as the relations between citizens and the state, codified in the mentioned histor-ical documents, are reflected in the current legislation of the Czech Republic. Descriptive, historical and comparative methods were used during the elaboration of this theme.
