Alternative Dispute Resolutions and their Use in International Trade Relations

Abstract:

V oblasti mezinárodního obchodu je řešení sporů téměř každodenní záležitostí. Na rozdíl od běžných občanskoprávních sporů jsou na ty v oblasti mezinárodního obchodu kladeny mnohem vyšší nároky. Je zapotřebí, aby řešení byly velice efektivní. Požadavkům mezinárodního obchodu zcela nevyhovuje řešení sporů před obecnými soudy, a proto se subjekty působící na poli mezinárodního obchodu velice často uchylují k alternativním způsobům řešení sporů. S rozvíjejícím se globálním světem se rozvíjí i internet a možnosti uzavírat obchody jeho prostřednictvím. Takto uzavíraným obchodům na dálku příliš neodpovídá použití prostředků řešení sporů, které musí probíhat za přítomnosti stran či jejich zástupců. Účelu řešení sporů vzniklých z elektronického obchodu nejlépe odpovídají alternativní způsoby řešení sporů za použití elektronické komunikace a informačních technologií tzv. Online způsoby řešení sporů. Těmto způsobům se práce věnuje. Popisuje a srovnává jejich výhody a nevýhody, popisuje jejich fungování a poskytovatele a zjišťuje, zda jejich použití nebrání zákonné překážky. Cílem práce je, zjistit zda online způsoby řešení sporů vyhovují požadavkům mezinárodního obchodu.

Abstract:

The dispute settlement in the international trade is almost a daily affair. The requirements on the International trade disputes settlement differ significantly from those on the civil disputes. Their requirements are much higher. It is essential that solutions are very effective. The civil court dispute resolution is an inconvenient one for the companies operating in the field of international trade, therefore these very often incline towards the ADR. The opportunity to do business on an online virtual base develops with the emerging global world and Internet. It isn’t much convenient for the international trade transactions concluded at a distance to use dispute settlement, which require the presence of parties or their representatives. The alternative dispute resolutions with the use of electronic communication and information technologies, so-called Online dispute resolutions, are best suited to resolve disputes arising from electronic commerce. This thesis deals with such alternative dispute resolutions as the online dispute resolutions (ODR). The thesis describes and compares their advantages and disadvantages, describes their functioning and service providers and finds out if the use of such dispute resolutions does not prevent legal obstacles. The aim of the thesis is to determine whether the online dispute resolution methods meet the requirements of the international trade.
