Clash of the right to information to the right of privacy in the media field

Abstract:

Tato práce se věnuje analýze problematiky střetu dvou základních lidských práv – práva na informace a práva na ochranu osobnosti – v mediální oblasti. Práce je rozdělena do několika částí, v první řadě obsahuje definici klíčových slov a pojmů. Následuje kapitola, věnovaná rozboru práva na informace, jeho popisu, omezením a souvisejícím pojmům. V další části je podobně podrobný popis druhého stěžejního práva – práva na ochranu osobnosti. Důraz je kladen především na relevantní atributy těchto právních institutů vůči mediím a jejich funkci. Proto práce zohledňuje nejen samotná práva, ale i další významné a úzce související aspekty, jakými jsou novinářská etika, vnější regulace a samoregulace médií, etické kodexy či tiskový zákon. Závěrečné kapitoly jsou pak věnovány konkrétním situacím, ve kterých se právo na informace a právo na ochranu osobnosti nejčastěji střetávají, a to včetně zákona č. 52/2009 Sb., neboli „náhubkového zákona“. Aktuálnost této tematiky spatřuji ve stále vzrůstající významnosti masových médií v demokratické společnosti a na to navazujících reakcí ze strany práva. Text si proto klade za cíl, přinést přehledný rozbor této problematiky pro její snadnější pochopení.

Abstract:

The bachelor thesis analyses the issue of clash between two main human rights – the right to information and right of privacy – in media realm. The thesis is divided into several chapters. Firstly, it contains definitions of key words and concepts. Secondly, next part focuses on analysis of the right to information, its description, limitations and related terms. Thirdly, the third chapter deals with the right of privacy in a similar manner as the second part works with the right to information. Strong emphasis is put on relevant attributes of these legal institutions towards media and their functions. That is the reason why this paper takes into account not only the rights themselves but also other significant and closely connected aspects of which journal ethics, outer regulation and self-regulation of media, ethic codex or press law are examples. The final chapters are consequently dedicated to concrete situations in which the right to information and right of privacy are most commonly found in conflict. Attention is paid to situation in which Act no. 52/2009 Col., or “náhubkový zákon” is applied. I found the up-to-date nature of this problematic in still rising importance of mass media in democratic societies and connected reaction from side of legislative body. The aim of the thesis is thus to bring a comprehensive analysis of the issue for its clear understanding and easy grip.
