Abstract:

Předmětem této diplomové práce je analýza institutu autorizovaného inspektora, jeho vznik a vývoj na základě časové přímky, jeho charakteristika a popis včetně jeho problémů a následných řešení. V první kapitole se věnuji možnostem umístění a povolení staveb před novelou stavebního zákona i po ní. Ve druhé kapitole podrobněji popisuji institut autorizovaného inspektora. Ve třetí kapitole se zabývám zkráceným stavebním řízením před novelou, včetně zahraniční inspirace. Čtvrtá kapitola obsahuje výčet podmínek pro vydání certifikátu autorizovaného inspektora. V páté kapitole je rozebrána judikatura týkající se dané problematiky. Šestá kapitola je věnována ustanovení § 142 správního řádu. Sedmá kapitola pojednává o „zkráceném stavebním řízení“ po novele stavebního zákona.

Abstract:

The subject of this thesis is the analysis of the Inspection Authority institute, its creation, chronological development, characteristic and description of its problems and their subsequent solutions. The first chapter focuses on the possibilities of building placement and construction permits before and after the amendment of the Building Act. The second chapter is dedicated to detailed description of the Inspection Authority institute. The third chapter is concerned with the reduced construction proceeding before the amendment of the Building Act, including insights from abroad. A list of requirements needed for the release of the Inspection Authority's certificate is the focus of the fourth chapter. Chapter five analyzes the jurisprudence concerned with the given issue. Chapter six addresses the provision § 142 of the Administrative Board and the seventh chapter focuses on the reduced construction proceeding after the Building Act amendment.
