Abstract:
Tato diplomová práce se zabývá účelem trestání, funkcemi trestání a teoriemi ospravedlňujícími trest. Nejprve se zaměřím na definici trestání a rozbor jeho základních funkcí. V další kapitole se budu podrobněji věnovat teoriím ospravedlňující trest. Teoriím utilitárním, retribučním a smíšeným. This diploma thesis deals with the purpose of punishment, the functions of punishment and theories justifying punishment. At first, I will introduce on the definition of punishment and the analysis of its basic functions. In the next chapter, I will discuss the theories justifying punishment in more detail.
