The Autonomy of Churches and Religious Societies in the Czech Republic Demonstrated on the Example of Establishing of Ecclesiastical Legal Entities

Abstract:

Tato práce pojednává o autonomii církví a náboženských společností, přičemž se zaměřuje zejména na zřizování církevních právnických osob, jako jeden z konkrétních příkladů, kdy se jedná o autonomii církví a náboženských společností. Práce se nejprve obecně zabývá právními předpisy, které se dotýkají autonomie církví a státu, poté představuje modely koexistence státu a církví. Následuje konkrétnější pohled na situaci v České republice na příkladu několika zajímavých judikátů, které se autonomií církví a náboženských společností zabývaly. Středem práce, doslova i obrazně, je téma zřizování církevních právnických osob. Touto problematikou se v roce 2002 a v roce 2006 zabýval Ústavní soud ČR, a proto i tato část práce vychází zejména z judikátů – nálezů Ústavního soudu ČR sp. zn. Pl. ÚS 6/02 a sp. zn. Pl. ÚS 2/06. Práce se zabývá mimo jiné i tím, zda došlo ke změně judikatury. Pochopení problematiky zřizování církevních právnických osob také vyžaduje seznámení se s problematikou rozdílů mezi evidencí a registrací, náboženské svobody a též otázkou omezování základních práv a svobod. Poslední část práce se opět vrací k obecnějšímu pohledu na autonomii církví a náboženských společností, a to s ohledem na hodnotové rozpory v naší civilizaci. Tyto rozpory autor práce považuje za jeden z možných faktorů ohrožujících autonomii církví a náboženských společností v budoucnu.

Abstract:

This work deals with autonomy of churches and religious societies, focusing especially on the religious establishing of ecclesiastical legal entities, as one of the specific examples where it is the autonomy of churches and religious societies. First the work deals with the general legislation affecting the autonomy of church and state, then a model of coexistence state and the church. The following is a more specific look at the situation in the Czech Republic on example of several interesting case law, that the autonomy of churches and religious societies deal. The center works, literally and figuratively, is the theme of the establishing of ecclesiastical legal entities. This issue in 2002 and 2006 dealt with the constitutional court, and therefore this part of the work is mainly based on case law - the constitutional court decisions no. Pl. ÚS 6/02 and no. Pl. ÚS. 2/06. The work deals inter alia, whether the first decision was changed by second decision. Understanding the issue of establishing of ecclesiastical legal entities also requires familiarity with the issue of differences between the records and registration, religious freedom and also the question of restrictions on fundamental rights and freedoms. The last part of the work returns to a more general view of the autonomy of churches and religious societies, with regard to discrepancies in the values ​​of our civilization. These contradictions author of the work considered to be one of the factors threatening the autonomy of churches and religious societies in the future.
