Legal Aspects of Administrative Punishment in the Field of Electronic Communication

Abstract:

Tato práce si klade za cíl popsat problematiku správního trestání na úseku elektronických komunikací. V úvodní části popisuje obecné pojetí správně právní odpovědnosti, včetně zásad a pravidel pro její uplatňování. Další kapitola se zabývá legislativním vývojem v této oblasti. Stěžejní část práce tvoří současná problematika správního trestání na úseku elektronických komunikací, ve které je popsáno konkrétní uplatňování správněprávní odpovědnosti s akcentem na problematiku ochrany spotřebitele. Na tuto část navazuje problematikou opravných prostředků, které je možno podat proti rozhodnutí o uložení pokuty. Závěrečná kapitola se zabývá problematikou současné právní úpravy se zaměřením na připravované změny v oblasti správního trestání.

Abstract:

This thesis aims to describe the problems of administrative punishment in the field of electronic communications. The first part describes the general concept of legal and administrative responsibility, including principles and rules for its implementation. Another chapter deals with legislative developments in this area. The main part consists of the current issue of administrative punishment in the field of electronic communications, which describes the specific application of administrative liability, with emphasis on the issue of consumer protection. This part is followed by the issue of remedies that may be brought against a decision imposing fines. The final chapter deals with the current legislation, focusing on the upcoming changes in the administrative punishment.
