Right of public use of Christian symbols in the European area

Abstract:

The thesis deals with the issue of conflictual introduction of Christian symbols in the European public sphere from the view of religious freedom and other rights arising in this context. The emphasis is given to the examination of the existence of differences between the treatment with Christian symbols as symbols of the dominant religion and with symbols of other religions. Initially, we generally define the display of religious symbols as a part of religious freedom and we introduce the concept of public sphere and symbol itself. In subsequent chapter, we provide analysis of the decisions of judicial bodies of the Council of Europe and we draw conclusions concerning the approach of these bodies to the Christian symbols in the public sphere compared to the other symbols. Lastly, we examine presented issues in the view of legislation and case law of the selected European countries which represent different existing concepts of relationship between public authorities and religion in Europe.

Abstract:

Práca sa zaoberá problematikou konfliktného vnášania kresťanských symbolov do verejného priestoru v regióne Európy z pohľadu náboženskej slobody a ďalších práv z nej v tomto kontexte vyvierajúcich. Dôraz je daný na preskúmanie existencie odlišností medzi zaobchádzaním so symbolmi kresťanskými ako symbolmi európsky dominantného náboženstva a symbolmi iných náboženstiev. Najprv všeobecne vymedzujeme zobrazovanie náboženskej symboliky ako súčasti náboženskej slobody a predstavujeme koncept verejného priestoru a symbolu ako takého. V nadväzujúcej kapitole prevádzame analýzu rozhodovacej činnosti judiciálnych orgánov Rady Európy a vyvoďujeme závery o prístupe týchto orgánov ku kresťanským symbolom vo verejnom priestore oproti symbolom ostatným. V záverečnej kapitole dochádza k preskúmaniu problematiky z pohľadu právnych predpisov a judikatúry u vybraných európskych krajín, reprezentujúcich rôzne prístupy verejnej moci k náboženstvu, ktoré sa v Európe vyskytujú.
