Hyperlink as a Copyrighted use of Work

Abstract:

Práce se zabývá právním režimem internetových odkazů a to především z pohledu práva autora na užití autorského díla a snaží se nalézt odpověď na otázku, zda umístění internetového odkazu spadá pod výlučné právo autora užít dílo. Za tímto účelem zkoumá institut sdělování díla veřejnosti, shrnuje současnou rozhodovací praxi a na základě syntézy těchto poznatků se pokouší formulovat odpověď na výše uvedenou otázku. Stav de lege lata podrobuje kritice a práce formuluje i některé názory de lege ferenda. Stručně se pak vyjadřuje i k problematice internetového odkazu jako účastenství na deliktu či jako zařazení díla do díla souborného.

Abstract:

This thesis deals with legal aspects of hyperlinks concerning the copyright law and trying to find an answer to the question, if hyperlink placement is covered by the author’s exclusive right to use the works. Concerning this purpose the thesis analyzes the communication of the work to the public right, summarizes decision – making praxis and tries to answer the question based on the synthesis of the findings. De lege lata status is a subject of a critical analysis and the thesis also formulates some of de lege ferenda opinions. The thesis also provides a brief summary of legal matters, namely hyperlink issues as secondary liability or a hyperlink as contribution to collective work.
