Tato diplomová práce se zabývá právní úpravou nemajetkové újmy při ublížení na zdraví a její náhrady v rakouském a českém právním prostředí, resp. její reflexí v judikatuře příslušných soudů. This thesis deals with the legislation related to immaterial damages for bodily harm and its compensation in Austrian and Czech legal environment, more precisely in judicature of corresponding courts. The thesis concerns the chosen approaches during the codification of this damage and how are they reflected in the judicature of Austrian OGH and Czech courts.
