Abstract:

This bachelor work deals with the issue of sport law, the work is specializes in existence of the legal aspects of sports, analysing the relationship of sports and law in terms of basic conceptes from the perspective of historical development, the international context and practice. The first chapter describes the basic concepts of sport law, characterizes the concept of sport, sport law and standards, defines sport law alone, the sources of sport law and the first chapter is also devoted to general issues of legal liability in sport and sancion mechanisms in sport. The second chapter focuses on the law and sport in our contry and the European Union, analyses the historical development of relationship between sport and law, describes development of relationship between sport and law from the perspective of the inernational context. The third chapter describes the legal practice and contractual relationship in sport, specifically deals with the content of contractual relationship, obligations of the club, player´s duties, it also describes the contractual relationship between athletes and clubs, contractual relations between the clubs with the impact on athletes. This chapter deals with a specific contracts and even the contract with coach, the contract with referee, contact with delegate agency and the manager. The last part of the third chapter id devoted to commercial law aspects of sport activities.

Abstract:

Bakalárska práca sa zaoberá témou Športové právo, práca sa špecializuje na existenciu právnych aspektov v športe, analýzou vzťahu športu a práva z pohľadu základných pojmov, z pohľadu historického vývoja, medzinárodného kontextu a praxe. Prvá kapitola popisuje základné pojmy športového práva, charakterizuje pojmy šport, právne a športové normy, definuje samotné športové právo, pramene športového práva a tiež sa prvá kapitola venuje pomerne širokej problematike právnej zodpovednosti v športe a sankčným mechanizmom v oblasti športu. Druhá kapitola je zameraná na právo a šport u nás a v Európskej únii, analyzuje historický vývoj vzťahu športu a práva, popisuje súdnu prax a vývoj vzťahu športu a práva z pohľadu medzinárodného kontextu. Tretia kapitola popisuje zmluvné vzťahy v športe, konkrétnejšie sa zaoberá obsahom zmluvných vzťahov, povinnosťami klubov, povinnosťami hráča, tiež popisuje zmluvné vzťahy medzi športovcom a klubom, zmluvné vzťahy medzi klubmi s dopadom na športovca. Táto kapitola sa zaoberá ďalšími konkrétnymi zmluvami a to aj zmluvou s trénerom, zmluvou s rozhodcom a delegátom, zmluvou s agentom a zmluvou s manažérom. V poslednej časti sa tretia kapitola venuje obchodnoprávnym aspektom športovej činnosti. V tejto časti popisujeme ilustratívne niektoré prípady súdnej praxe vo vybraných štátoch.
