Questioning the Validity of the Beneš Decrees

Abstract:

Tato bakalářská práce se zabývá tématem Zpochybňování platnosti tzv. Benešových dekretů. V první části je popsán proces vzniku, vývoje a rozsahu pravomocí Prozatímního státního zřízení. Poté je ve stručnosti charakterizováno, co se rozumí tzv. Benešovými dekrety, způsob, jakým byly přijímané a zda a nakolik jsou dnes závazné. Stěžejní část práce se věnuje česko-německým a česko-rakouským vztahům a vlivem tzv. Benešových dekretů na tyto vztahy. Zmíněna je i otázka poválečného odsunu sudetských Němců. Dále jsou zde rozebrány hlavní argumenty těch, jež zpochybňují platnost těchto dekretů. Roli, jakou tyto argumenty hrály v procesu rozšiřování Evropské unie a nakolik představovaly překážku pro vstup České republiky do EU. Poslední část se věnuje rozboru rozhodnutí Ústavního soudu ČR týkajícího se tzv. Benešových dekretů. Cílem práce je analyzovat, zda byly tzv. Benešovy dekrety platně přijaty, zda argumenty používané kritiky těchto předpisů mají reálný základ a tedy existují důvody napětí ve vztahu České republiky a jejích německy mluvících sousedů.

Abstract:

The thesis deals with the Questioning the Validity of the Beneš Decrees. The first part of the thesis describes the process of establishment, development and extent of power of Czechoslovak government-in-exile. After that there is a brief description of what the so-called Beneš decrees are, the way they were passed and today's legal effects. The main part of thesis deals with the Czech-German relations and the Czech-Austrian relations and the impact of the so-called Beneš decrees on these relations. The issue of the afterwar transfer of Sudeten Germans is also covered. Then there is analysis of the main arguments of people, which question validity of the presidential decrees. There is also description of the role, which these arguments played in the process of the enlargement of the European Union and how much the so-called Beneš decrees were obstacles to the entrance of the Czech Republic into the European Union. The last part of thesis deals with the analysis of the Czech Constitutional Court decision relating to the so-called Beneš decrees. The aim of this thesis is to analyse, if the so-called Beneš decrees were validly passed, if arguments of critics of these rules have actual grounds and if there are reasons for tensions in relations between The Czech Republic and its German speaking neighbours.
